1. Acceptance of Terms

By accessing or using paceai's smart glasses, companion mobile application, website (paceai.dev), APIs, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the Services.

2. Description of Services

paceai provides AI-powered smart glasses and companion software designed to improve reading speed, comprehension, and accessibility. The Services include:

• Real-time word highlighting and adaptive reading speed on physical and digital text
• On-demand word definitions and contextual explanations
• AI-generated chapter summaries and reading recaps
• Reading analytics, progress tracking, and comprehension scoring
• Accessibility features including dyslexia mode, ADHD focus mode, and multi-language support
• Companion mobile application for settings, library management, and analytics
• Cloud-based AI services for summaries, definitions, and personalization

3. Eligibility

You must be at least 13 years old to use the Services. If you are under 18, you must have the consent of a parent or guardian. If the Services are used in an educational setting, the school or educational institution may consent on behalf of students under 13 in accordance with COPPA and FERPA.

4. Account Registration

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized use of your account
• One account per person; accounts are non-transferable

5. Subscriptions and Payments

5.1 Free Tier

Basic word highlighting functionality is available at no cost with the purchase of paceai glasses.

5.2 paceai Pro

Premium features (cloud summaries, advanced analytics, unlimited definitions, collaborative reading) require a paceai Pro subscription at $9.99/month or $99/year. Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date.

5.3 Refunds

Hardware purchases may be returned within 30 days of delivery for a full refund, provided the product is in its original condition. Subscription refunds are handled on a case-by-case basis.

6. Acceptable Use

You agree not to:

• Use the Services for any illegal purpose
• Reverse engineer, decompile, or disassemble the glasses firmware or software
• Attempt to access other users' accounts or data
• Use the camera or eye-tracking features to record, surveil, or monitor other people without their consent
• Distribute, modify, or create derivative works from the Services without our permission
• Use the Services to infringe on the intellectual property rights of others
• Interfere with or disrupt the Services or servers

7. Intellectual Property

All intellectual property in the Services — including software, AI models, hardware designs, trademarks, and content — is owned by paceai Inc. or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial purposes (or commercial purposes if on an enterprise plan).

Your reading data, annotations, and personal content remain yours. We do not claim ownership of any text you read or notes you create using the Services.

8. AI-Generated Content

The Services generate AI-powered content including summaries, definitions, comprehension quizzes, and reading insights. This content is provided for informational and educational purposes only. We do not guarantee the accuracy, completeness, or reliability of AI-generated content. You should not rely on AI summaries as a substitute for reading the original material.

9. Hardware Warranty

paceai glasses are covered by a limited one-year warranty from the date of purchase, covering defects in materials and workmanship under normal use. The warranty does not cover damage from misuse, accidents, unauthorized modifications, or normal wear and tear. See the warranty card included with your glasses for full details.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. paceai DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED. WE DO NOT GUARANTEE SPECIFIC READING SPEED IMPROVEMENTS, COMPREHENSION GAINS, OR EDUCATIONAL OUTCOMES.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, paceai SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICES IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Educational Use

When the Services are used in educational settings:

• Schools and institutions are responsible for obtaining necessary parental consents
• Student data is handled in compliance with FERPA and applicable state student privacy laws
• Teacher dashboards display only aggregated metrics, not raw reading content
• Student data is not used for advertising or non-educational purposes

13. Termination

We may suspend or terminate your access to the Services at any time for violation of these Terms or for any other reason with reasonable notice. Upon termination, you may export your data within 30 days. After 30 days, your data will be deleted in accordance with our Privacy Policy.

14. Changes to Terms

We may modify these Terms at any time. We will provide at least 30 days' notice for material changes via email or in-app notification. Continued use of the Services after changes take effect constitutes your acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Delaware.
